Als ich meinen ersten Immobilienkauf in der Axarquía begleitete, saß ich mit einer Mappe voller Dokumente im Auto vor dem Notariat in Torrox und hatte das Gefühl, jeden Moment könnte irgendetwas fehlen, das den ganzen Termin platzen lässt. Dieses Gefühl kenne ich heute noch, aber inzwischen weiß ich genau, wo die typischen Stolperfallen liegen, und das macht den entscheidenden Unterschied.
- Der Grundbuchauszug (Nota Simple) ist veraltet oder unvollständig: Viele Käufer verlassen sich auf einen Auszug, der zum Zeitpunkt der ersten Besichtigung geholt wurde, Monate später, kurz vor der Beurkundung, können sich Lasten, Hypotheken oder Eigentumsverhältnisse geändert haben, ohne dass es jemand bemerkt.
- Der baurechtliche Status der Immobilie ist unklar: Gerade bei ländlichen Fincas fehlt häufig das DAFO-Zertifikat, oder es gibt Abweichungen zwischen dem Katastereintrag und der tatsächlichen Bausubstanz, ein Thema, das wir bereits ausführlich behandelt haben, weil es so viele Käufer überrascht.
- Fehlende oder falsch übersetzte Dokumente aus dem Heimatland: Geburtsurkunden, Eheurkunden, Vollmachten, spanische Notare verlangen häufig beglaubigte Übersetzungen und eine Apostille. Wer das erst kurz vor dem Notartermin bemerkt, verliert wertvolle Wochen.
- Die Steuernummer (NIE) wird zu spät beantragt: Ohne NIE keine notarielle Beurkundung, kein Bankkonto, keine Grunderwerbsteuer-Zahlung. Dieser Schritt gehört an den Anfang des Prozesses, nicht ans Ende.
- Fehlende Abstimmung zwischen Anwalt, Notar und Bank: In Spanien arbeiten diese drei Parteien nicht automatisch koordiniert zusammen wie in manchen anderen Ländern. Wenn niemand den Gesamtprozess aktiv steuert, entstehen Verzögerungen an den Schnittstellen, nicht, weil einzelne Beteiligte nachlässig wären, sondern weil niemand die Gesamtverantwortung trägt.
Die ehrliche Wahrheit: Die meisten Verzögerungen beim Immobilienkauf in Andalusien liegen nicht an der spanischen Bürokratie selbst, sondern daran, dass Käufer die Reihenfolge und Abhängigkeiten der einzelnen Schritte nicht kennen. Ein Prozess, der bei guter Vorbereitung sechs bis acht Wochen dauert, kann sich ohne diese Vorbereitung leicht auf vier bis sechs Monate ausdehnen, mit allen finanziellen und emotionalen Kosten, die das mit sich bringt.
Ich erinnere mich an ein Paar aus den Niederlanden, das uns erst kontaktierte, nachdem ihr eigener Kaufprozess bereits fünf Monate lang ins Stocken geraten war, wegen einer fehlenden Übersetzung, die niemand rechtzeitig angefordert hatte. Innerhalb von drei Wochen, nachdem unsere Kanzlei den Prozess übernommen und koordiniert hatte, stand der Notartermin.
Was einen reibungslosen Immobilienkauf in Andalusien tatsächlich ausmacht, ist selten Glück. Es ist die konsequente Einhaltung einer klaren Reihenfolge:
Zuerst die rechtliche und baurechtliche Prüfung der Immobilie, bevor überhaupt eine Anzahlung fließt. Dann die parallele Beantragung von NIE-Nummer und Bankkonto, während die rechtliche Prüfung läuft. Anschließend die Koordination aller notwendigen Dokumente mit ausreichendem zeitlichen Vorlauf für Übersetzungen und Beglaubigungen. Und schließlich ein Notartermin, der erst dann angesetzt wird, wenn wirklich alle Voraussetzungen erfüllt sind, nicht davor.

There is a phrase that almost every expat says at some point, usually with a mixture of gallows humor and genuine despair: „In Spain, everything takes twice as long and needs three times as many stamps.“ I said this myself, multiple times, before I understood that Spanish bureaucracy is not arbitrary, but a system with its own logic that you simply need to know.
When I accompanied my first property purchase in the Axarquía, I sat with a folder full of documents in the car outside the notary’s office in Torrox, feeling that at any moment something could be missing that would ruin the entire appointment. I still know this feeling today, but now I know exactly where the typical pitfalls lie, and that makes the decisive difference.
- The land registry excerpt (Nota Simple) is outdated or incomplete: Many buyers rely on an excerpt obtained at the time of the first viewing. Months later, shortly before the notarization, liens, mortgages, or ownership conditions may have changed without anyone noticing.
- The building-law status of the property is unclear: Especially with rural fincas, the DAFO certificate is often missing, or there are discrepancies between the cadastre entry and the actual building structure, a topic we have already dealt with in detail because it surprises so many buyers.
- Missing or incorrectly translated documents from the home country: Birth certificates, marriage certificates, powers of attorney, Spanish notaries often require certified translations and an apostille. Anyone who notices this shortly before the notary appointment loses valuable weeks.
- The tax number (NIE) is applied for too late: Without an NIE, there is no notary certification, no bank account, no property transfer tax payment. This step belongs at the beginning of the process, not at the end.
- Lack of coordination between lawyer, notary, and bank: In Spain, these three parties do not automatically work together in a coordinated manner as in some other countries. If no one actively manages the overall process, delays occur at the interfaces, not because individual participants are negligent, but because no one bears overall responsibility.
The honest truth: most delays when buying property in Andalusia are not due to Spanish bureaucracy itself, but because buyers do not know the order and dependencies of the individual steps. A process that takes six to eight weeks with good preparation can easily stretch to four to six months without it, with all the financial and emotional costs that entails.
I remember a couple from the Netherlands who only contacted us after their own purchasing process had already stalled for five months, because of a missing translation that no one had requested in time. Within three weeks after our firm took over and coordinated the process, the notary appointment was scheduled.
What actually makes a smooth property purchase in Andalusia is rarely luck. It is the consistent adherence to a clear order:
First the legal and building-law check of the property, before any deposit is paid. Then the parallel application for the NIE number and bank account while the legal check is underway. Next, the coordination of all necessary documents with sufficient lead time for translations and certifications. And finally, a notary appointment that is only scheduled when all requirements are truly met, not before.

- El extracto del registro de la propiedad (Nota Simple) está desactualizado o incompleto: Muchos compradores confían en un extracto obtenido en el momento de la primera visita. Meses después, poco antes de la escritura, las cargas, hipotecas o condiciones de propiedad pueden haber cambiado sin que nadie se dé cuenta.
- El estado legal y urbanístico de la propiedad no está claro: Especialmente en las fincas rústicas, a menudo falta el certificado DAFO, o hay discrepancias entre la inscripción catastral y la edificación real, un tema que ya hemos tratado en detalle porque sorprende a muchos compradores.
- Documentos del país de origen ausentes o mal traducidos: Certificados de nacimiento, certificados de matrimonio, poderes notariales, los notarios españoles suelen exigir traducciones juradas y la ampostilla. Quien se dé cuenta de esto poco antes de la cita con el notario perderá semanas valiosas.
- El número de identificación fiscal (NIE) se solicita demasiado tarde: Sin NIE no hay escritura notarial, ni cuenta bancaria, ni pago del impuesto de transmisiones patrimoniales. Este paso pertenece al principio del proceso, no al final.
- Falta de coordinación entre abogado, notario y banco: En España, estas tres partes no trabajan automáticamente de forma coordinada como en otros países. Si nadie gestiona activamente el proceso global, se producen retrasos en los puntos de contacto, no porque las partes implicadas sean negligentes, sino porque nadie asume la responsabilidad global.
La pura verdad: la mayoría de los retrasos al comprar una propiedad en Andalucía no se deben a la burocracia española en sí, sino a que los compradores no conocen el orden y las dependencias de cada paso. Un proceso que con una buena preparación dura de seis a ocho semanas, puede alargarse fácilmente de cuatro a seis meses sin ella, con todos los costes financieros y emocionales que ello conlleva.
Recuerdo a una pareja de los Países Bajos que solo se puso en contacto con nosotros después de que su propio proceso de compra llevara estancado cinco meses, debido a una traducción que faltaba y que nadie había solicitado a tiempo. A las tres semanas de que nuestro despacho se hiciera cargo y coordinara el proceso, se fijó la cita con el notario.
Lo que realmente hace que la compra de una propiedad en Andalucía sea un proceso sin sobresaltos no suele ser la suerte. Es el cumplimiento constante de un orden claro:
Primero, la comprobación legal y urbanística de la propiedad, antes de realizar cualquier pago a cuenta. Después, la solicitud paralela del número de NIE y de la cuenta bancaria mientras se realiza la comprobación legal. A continuación, la coordinación de todos los documentos necesarios con suficiente antelación para las traducciones y legalizaciones. Y, por último, una cita con el notario que solo se fija cuando se cumplen realmente todos los requisitos, no antes.

Ce qui fait réellement de l’achat d’une propriété en Andalousie un processus sans accroc n’est pas souvent la chance. C’est le respect constant d’un ordre clair :
D’abord, la vérification légale et urbanistique de la propriété, avant de réaliser le moindre paiement d’acompte. Ensuite, la demande parallèle du numéro de NIE et du compte bancaire pendant que s’effectue la vérification légale. Puis, la coordination de tous les documents nécessaires suffisamment à l’avance pour les traductions et légalisations. Et enfin, un rendez-vous chez le notaire qui n’est fixé que lorsque toutes les exigences sont réellement remplies, pas avant.

- Het fiscaal nummer (NIE) wordt te laat aangevraagd: Zonder NIE is er geen notariële akte, geen bankrekening en geen betaling van de overdrachtsbelasting. Deze stap hoort aan het begin van het proces, niet aan het einde.

De naakte waarheid: de meeste vertragingen bij de aankoop van vastgoed in Andalusië zijn niet te wijten aan de Spaanse bureaucratie zelf, maar aan het feit dat kopers de volgorde en afhankelijkheden van elke stap niet kennen. Een proces dat met een goede voorbereiding zes tot acht weken duurt, kan zonder die voorbereiding gemakkelijk uitlopen tot vier tot zes maanden, met alle financiële en emotionele kosten van dien.
Ik herinner me een echtpaar uit Nederland dat pas contact met ons opnam nadat hun eigen koopproces al vijf maanden stillag, vanwege een ontbrekende vertaling die niemand op tijd had aangevraagd. Binnen drie weken nadat ons kantoor de leiding had genomen en het proces had gecoördineerd, werd de afspraak bij de notaris vastgelegd.
Wat de aankoop van een pand in Andalusië echt tot een proces zonder hindernissen maakt, is zelden geluk. Het is het consequent naleven van een duidelijke volgorde:
Eerst de juridische en bouwkundige controle van het pand, nog voorafgaand aan de aanbetaling. Vervolgens de parallelle aanvraag van het NIE-nummer en de bankrekening terwijl de juridische controle plaatsvindt. Daarna de coördinatie van alle benodigde documenten met voldoende voorsprong voor vertalingen en legalisaties. En tot slot een afspraak met de notaris die pas wordt vastgelegd wanneer er daadwerkelijk aan alle vereisten is voldaan, niet eerder.
